If you disagree with a decision made by the Local Authority about the education of your child or young person with special educational needs, you have a right to appeal it. If you decide to appeal a decision, it is important that the appeal is prepared with evidence that will help meet the legal test.
Challenge
You need to make sure that you have all the right evidence required to show the SEND Tribunal that all your concerns and the points that you have raised are right. Your concerns may be due to the type of provision or lack of provision for your child at school. The burden of proof at the SEND Tribunal is on a balance of probabilities, the duty will be on you to make and prove your points.
Solution
You may feel confident to gather the evidence and prepare the Appeal all by yourself, which is excellent.
