What is a SEND tribunal?
You have a right to appeal against a decision made by a local authority about the education of a child or young person with SEND. This appeal is heard and decided at a SEND tribunal.
What can you appeal about?
You can appeal to the tribunal about:
- a local authority’s decision not to do an EHC needs assessment (or re-assessment)
- a local authority’s decision, following an assessment, that they do not need to issue an EHC Plan
- the way that special educational needs are described in an EHC Plan
- the special educational provision specified in an EHC Plan
- the school, institution or type of institution specified in an EHC Plan (or the fact that no school or other institution is specified at all)
- changes to any of these parts of the EHC Plan
- a local authority’s decision not to change an EHC Plan after a review or re-assessment, or to stop maintaining it

If not, your case will go to a tribunal hearing. We can help you prepare your case before the hearing, and/or represent you at the tribunal itself, so you don’t have to put your own case to the court.
